Contained below are our terms and conditions.  If there are any queries regarding this or any other aspect of your hire, please contact us and we will do our best to answer your questions.

Terms & Conditions

In these terms and conditions “Hirer” means the person or persons who hire a vehicle from Braes Motorhome Hire under these terms and conditions of rental.

The Payment must be made by the driver, on the day of hire, 2 forms of identification will be required along with driving licence, all 3 documents must have the same address.

  1. Booking

A booking is only binding after conformation from Braes Motorhome Hire and a deposit of 40% of the total booking hire fee has been received.  Our cancellation policy will apply from the point of payment received. 

Once the deposit is paid we will send conformation by email of your booking showing guests the balance paid and balance due.

The remaining balance will be due 6 weeks prior to hire start date.

A refundable security deposit of £500 must be paid 7 working days prior to hire, to cover insurance excess, any damages or road traffic fines. Payment can be made by credit or debit card through Paypal or by cheque all monies must be cleared before collection of the vehicle, the security deposit will be returned less any incurred costs approximately 14 days after the return of the vehicle by bank transfer.

I irrevocably authorise Braes Motorhome Hire to deduct any amounts due by me from the security deposit of this agreement to Braes Motorhome Hire.

  1. Security deposit and charges which may be deducted

Fully refundable security deposit of £500 will be returned in full provided all the conditions of the hire agreement are met by you returned undamaged and in the same condition that you received it. This will also act as your insurance excess.

Return vehicle the same way as you received it or a valeting fee of £30 will be charged.

Chemical toilet and waste water to be cleaned and emptied at a caravan site before return if this is not done we will charge £50 soiling fee.

Late returns will be charged at £25 per hour or part hour this will commence at 10.30am on the return date, we have a time scale to have the vehicle ready for the next hirer. No refunds for early returns.

Fuel tank must be returned to the same level indicated on departure or we will make an estimation of usage.

LPG tank not every service station sells it, we will calculate usage at £10 for a week hire and £5 for a 3 day hire.

 

  1. Drivers & Insurance

Driving licence we require a pin code from DVLA to check licence photo ID

  • From the 8th June 2015, the counterpart to the photo card driving licence will not be valid and will no longer be issued.
    ALL penalty points and driving entitlements of both photo card and paper licence holders will be recorded online. Braes Motorhome Hire has a legal responsibility to check your driving licence for endorsement in order to provide insurance under the Road Traffic Act legislation.

  • You can share your driving licence details online for free by generating a ‘check code’ which allows us to log on and view your details.  Go to https://www.gov.uk/view-driving-licence and enter your driving licence number, National Insurance number and the postcode shown on your driving licence. Select the “Share your licence information” tab and then click the “Create a code” Please note the check code is case sensitive and can only be used once. You can download and print a PDF summary of your licence, including your check code, by selecting View, print or save your licence information. You need to give the check code to us before you collect your vehicle so that we can log on and view your details.

  • If you do not have access to a computer at home then you can bring your driving licence, National Insurance number and identification with you, when you arrive to collect your vehicle we will give you access to one of our computers so you can generate a check code. You then need to give the check code to us so that we can log on and view your details.

  • If you can’t do either of the above, you will be asked to give your permission verbally over the telephone to DVLA, so that they can disclose your driving licence information to us. This is a premium rate telephone service and there will be a charge of £3.00 per licence for choosing this option. Please note this service is only available Monday to Friday 8am to 7pm and Saturdays 8am to 2pm (not including Bank Holidays). We will be unable to hire to you if you select this option outside of their operating hours.

All drivers confirm by signing this agreement that they have none of the following conviction codes on their license within the last 5 years :

AC,BA,CD40-71,DD,DR,IN,LC30-50,MS40-90,UT

Signing this agreement and driving the vehicle with any of the above offence codes on your license within the last 5 years, is an offence and invalidates the insurance, and the hirer will be liable for all and any costs incurred by Braes Motorhome Hire in the event of any damages or insurance claims as a result of the hire.

Drivers

  • Must have a valid full UK licence for a minimum of two years (EU, Australian, Canadian, United States and New Zealand are also valid) if you are from another country please get in contact with us before booking, we shall refer you to our insurance company to check if they will offer insurance cover.

  • Must be aged between 21 and 75 and of good health.

  • All drivers must be present at the time of vehicle collection and produce a photo driving licence and paper copy. If licence is an old style UK paper the hirer must produce photographic identification in the form of a passport.

Visitors from abroad must produce a valid unendorsed domestic licence or international licence as well as a passport.

  • Licence offences must meet the driver eligibility requirements of the insurance company.

  • A refundable deposit of £500 must be paid prior to rental to cover insurance policy excess, European drivers out with the UK are required to pay £750 security deposit to cover insurance policy excess.

 

Security Deposits to cover insurance excess

Age 21 – 22 £1000.00

Age 23 – 24 £750.00

Age 25 – 75 £500.00

Foreign Licence £750.00

 

HIRER DRIVE ENDORSEMENT 

This insurance covers the Insured Vehicle whilst let out on hire, subject to the following conditions: -  

1) The Insured shall verify the identity and permanent address of the Hirer and any other permitted driver by means other than relying solely on the information contained in the Hirer’s or driver’s driving licence and that such person is not amongst the excluded persons enumerated below.

2) Two forms of ID shall be obtained, Utility Bills from different companies (no more than 60 days old) and Driving Licence all with the same address.

3) The Insured Vehicle shall not be let out on hire to or be driven by: - 

a) Hirers under 21 or over 75 years of age unless otherwise agreed by the Insurer 

b) Hirers under 25 or over 75 years of age if vehicle is a Minibus, MPV (8 seats including driver) or 7.5 ton GVW or above. 

c) Hirers who have not held a full valid United Kingdom or EU driving licence for 2 years.

d) Persons who have been convicted of an offence in connection with the driving of a motor vehicle or motorcycle and/or have had their driving licence endorsed or suspended or more than 6 penalty points imposed. “Spent” convictions, covered by the Rehabilitation of Offenders Act 1974 may be disregarded. 

Parking and not more than two speeding offences in the past 3 years may be ignored. "

e) Persons who have had their insurance declined and/or renewal refused and/or special insurance terms imposed as a result of claims experience and/or have had their insurance or cover cancelled by any Motor Insurer. 

f) Persons engaged wholly or partly in professional entertainment or professional sports persons. 

g) Jockeys and persons connected with racing, gaming industry or press of any sort. 

h) Undergraduates and/or students under 25 years of age. 

i) Persons who, whilst driving, have been involved in more than one accident during the past 3 years.

 j) Foreign Service Personnel other than persons holding a full UK/EU licence for two years or more.

k) Persons who have had any pre-existing medical conditions; which may affect driving ability.

4) The insured vehicle(s) shall be driven only by the Hirer or other permitted driver who has completed and signed a hirer drive proposal (by each hirer or other permitted driver). Such proposal shall be forwarded on request to the Insurers. The proposal must be fully completed by the Hirer or other permitted driver in all respects. In addition to the usual declaration and warranty contained in the proposal, the following declaration shall appear on the proposal, namely: - “I further agree to be bound by the terms and conditions of the Insurance which I have seen and read or have had the opportunity to see and read”.  If the statements and particulars in the proposal are in the handwriting of any person other than the Hirer or other permitted driver, such person shall be deemed to have been the Hirer’s or other permitted driver’s agent for the purpose of completing the proposal form. 

5) The Insured shall be considered as the being the agent for the Hirer or other permitted driver for all purposes in connection with this insurance but under no circumstances shall the Insured be considered as agent for the Insurers. 

6) The Insured vehicle shall not be used for the carriage of goods of an explosive, dangerous or hazardous nature or for the carriage of goods or passengers for hire and reward.  

7) Any vehicle which is added to the Motor Insurance Database will be charged the appropriate premium.  

Subject otherwise to the terms, exceptions and conditions of this insurance  

 

   4.     Passengers

Must comply with the law all passengers must use safety restraints at all times while the vehicle is in motion, this is the hirers responsibility.

  1. Child seats

The UK regulations on child car seats, specify that every child under 135cm or 12years of age should be seated with specified restraints while travelling in a vehicle. It is the hirers duty to make sure that the appropriate child seats are used in the vehicle with children. Contact Braes Motorhome Hire for availability of free booster seats.

  1. Vehicle Conditions

The hirer is advised to check the vehicle thoroughly before the commencement of the hire and before leaving the premises of Braes Motorhome Hire. The hirer acknowledges the vehicle and its contents free from damage or defects, unless stated by Braes Motorhome Hire.

The vehicle must be returned clean and in the same condition as when hired.

No stiletto heels to be worn inside motorhome.

  1. Cancellations and charges

Cancellations must be in writing, In the event of a cancellation the following charges will apply

  • More than 6 weeks notice an amount equal to booking deposit.

  • Less than 4-6 weeks notice 50% of total hire charge.

  • Less than 4 weeks before start date notice 100% of total hire charge.

We will use all reasonable endeavours to re-hire the vehicle to alternative hirers and if we are successful we may be able to reduce the above charges.

  • If you do not arrive for your hire, you will forfeit your full amount paid. 

  • If drivers licences are found to be invalid and do not comply with the information given on the booking form or not in accordance with the applicable terms of the insurance policy you will forfeit your booking and hire charge.

  • We recommend that the hirer takes out cancellation insurance.

Braes Motorhome Hire cannot postpone or transfer money from one hire to another.

Braes Motorhome Hire reserves the right to amend our cancellation policy for certain events.

  1. Collection & Return

Collection of the vehicle is from 3 - 4pm on your first day of hire please allow half an hour for the completion of all necessary paperwork and to demonstrate our vehicle to you. The hirer acknowledges that having received the vehicle in a clean and sound working order and free from any defects or damage in accordance with the departure check list. Full tank of fuel and LPG at indicated level.

Return of the vehicle is 9 - 10 am please allow up to half an hour to hand over and check the vehicle, it must be returned clean and in the same condition that you received it and with a full tank of diesel and full tank of LPG if possible.

The vehicle must be returned in accordance with the hire agreement, if the hirer is delayed for any reason they must contact Braes Motorhome Hire additional charges may be applied; as after the stated time the vehicle is being driven uninsured and will be illegal to drive. Failure to return on hire return date will implement a charge of £150 plus the daily hire rate. We rely on our hirers to cooperate with us and to notify us immediately, it is essential that we operate in our time scale and have the vehicle ready for its next hire.

If the hirer ceases to have use of the vehicle or returns early prior to the return date for any reason e.g. weather, accident or theft Braes Motorhome Hire will not refund any monies nor be obligated to provide a replacement vehicle.

Collections and Returns out with the above times must be agreed with Braes Motorhome Hire in advance.

  1. Title to vehicle

I acknowledge that Braes Motorhome Hire keeps title of the vehicle as the bailer, as a mere bailee I have the goods for hire only, I shall not sell, assign, lend, pledge, sublet the hire, or part with or attempt to part with the vehicle and its contents as I am aware that I have no rights and agree not to do so.

  1. Suitable persons

Braes Motorhome Hire has the right to refuse to hire our motorhome to any person who we feel is not suitable to take charge of the vehicle, we may have concerns for the safety of other road users, our vehicle and that of any passengers. In this situation we will give a refund straight away.  Braes Motorhome Hire has no obligation to refund campsites booked in advance or any other events or travel which you may have booked or any other circumstances. The liability of Braes Motorhome Hire will be limited to pay the hirer a return of monies paid; the hirer will have no further claims against Braes Motorhome Hire.

  1. The Motorhome shall not be used

I agree that throughout the time of hire, I shall not or will not allow the motorhome to be:

  • Used to carry passengers or goods for hire or reward.

  • Used to propel or tow any other vehicle, or trailer.

  • Used to carry more passengers than those seat belted or more baggage than recommended by the manufacturer.

  • Driven any other way than in a cautious normal manner.

  • Used in a manner that could cause damage.

  • Used for racing, rallying, speed testing, contest or driver tuition.

  • Driven by anyone who has given a false name.

  • Driven outside or removed from UK mainland unless confirmed with Braes Motorhome Hire and the appropriate insurance has been paid.

  • Left unoccupied with the ignition key in the vehicle.

  • Left unoccupied without the alarm activated and any valuables covered up or put in cupboards. 

  • Knowingly for any illegal purpose.

  • Used by any person who is under the influence of alcohol or drugs or with a blood alcohol level above the legal limits.

  • Driven by anyone not named on the hire agreement, in exception to a motorhome repairer in the event of a breakdown or accident.

  •  Used for travel to music festivals or unauthorised sports events without the consent of Braes Motorhome Hire.

  • Damaged by submersion in water or contact with salt water.

  •  Used to carry explosives, gases or any other corrosive or inflammable material.

  1. Breakdown & accidents

In the event of a breakdown or accident, the hirer may contact the AA for roadside assistance using the contact and information details are in the rental documents.

Every effort is made to ensure the motorhome is in a roadworthy and safe condition before hire commencement. Braes Motorhome Hire will not be responsible for any third party damages or claims in connection with, or as consequence of any accident or breakdown and shall not be liable for any consequences arising from defects or mechanical failure. Braes Motorhome Hire will not be held responsible for any hotel, replacement vehicle or any other expenses connected to breakdown or accidents. The hirer may give permission for the cost of repairs up to the value of £50 the money will be refunded on production of a valid receipt. The hirer must obtain approval of Braes Motorhome Hire for any repair and replacement costs above £50. The motorhome should not be used until damage has been repaired, corrected and fault determined.

In the Event of any accident, however small.

  • A complete accident report must be filled out and returned to Braes Motorhome Hire on return of the vehicle. Including a sketch of the accident.

  • The hirer should notify Braes Motorhome Hire within 24hours of the happening of the event.

  • Obtain names and addresses, insurance details and vehicle details of third parties and any witnesses and report the event to the nearest police station.

  • Notifying police immediately if there is property damage, if people are injured and in order to determine fault for insurance purposes.

  • The hirer should not make any admission of guilt or liability to other parties, settlement offer or other like offer.

  • Assist Braes Motorhome Hire in handling any claim arising from any event, including providing all relevant information and attending court to give evidence.

  • The hirer must not abandon the motorhome without taking adequate steps to prevent further damage, loss or violation of traffic regulations

  • Any breakdown, malfunction or damage caused by the hirers negligence must be repaired/made good at the hirers own expense.

  1. Penalties, fines, charges

Fines obtained by the hirer or the other driver for the violation of road traffic act regulations, shall be the responsibility of the hirer or the other driver any penalty, congestion charges fine, or any other charge or offence must be paid in full immediately. Braes Motorhome Hire is not accountable for such liabilities. If Braes Motorhome Hire receives any notices for fines or charges included but not limited to fines and penalties, parking fines, speeding fines, (including court costs) etc. On receipt of any notices Braes Motorhome Hire will add an administration fee of £25 to the penalty, fine or charge to cover administration and postage costs for the redirection of any penalty notices.

  1. Payment of charges joint and several liability

I agree that I will pay all charges and expenses due by me to Braes Motorhome Hire on demand. I agree to pay a late charge fee of 1.5% per month on the outstanding balance of what I am due and any collection costs obtained by Braes Motorhome Hire, which includes plausible legal fees. I agree that where there is more than one customer each person is jointly and severally liable for all obligations to this agreement.

  1. Fuel, Gas &Tyres

Fuel is at the expense of the hirer; if the vehicle has a full tank on collection then must be returned with a full tank of fuel; if it is not Braes Motorhome Hire will charge accordingly.

LPG tank is charged at £10 per week or £5 per 3 day hire.

The hirer is responsible for checking engine oil & water levels along with tyre pressure at least once a week.

Should the hirer put the wrong fuel in the tank (fuel being diesel or petrol) they will be liable and charged the full cost of repairing the damage to the vehicle.

The hirer is solely responsible for the costs of repairs to tyres and punctures.

  1. Availability

Due to circumstances beyond our control if the motorhome you have booked is not available due to accident damage, weather conditions or any other unforeseen circumstances, if we cannot supply you with a similar size vehicle; we will refund your payment made to us immediately. Braes Motorhome Hire will have no obligation to refund campsites booked in advance or any other events or travel which you may have booked or any other circumstances. The liability of Braes Motorhome Hire will be limited to pay the hirer a return of monies paid, the hirer will have no further claims against Braes Motorhome Hire.

  1. Weather conditions

Braes Motorhome Hire will not be held accountable in the event of any inconvenience or damage caused to your hire by inclement weather conditions.

   18. No Smoking

There is no smoking in the vehicle, we have provided a pop ashtray to dispose of your cigarettes ends so as not to litter outside the vehicle.

   19. Restrictions roads

The motorhome can only be driven on sealed bitumen roads.

The motorhome shall not be driven on unauthorised roads, in restricted or forbidden areas or in salt water or any beaches.

I am aware that Braes Motorhome Hire reserves the right to restrict the motorhome's movements due to inclement weather conditions or any other plausible cause.

   20. Keys & control

The hirer is responsible to keep the motorhome under their control throughout the hire period.

The motorhome must be locked at all times when unattended and alarm activated.

The keys must be kept safe at all times, costs to replace the keys will be the hirer’s responsibility, and duplication of the keys is prohibited.

  21. Customer vehicle car parking

Braes Motorhome Hire offer one free parking space to the hirer for the duration of the hire period, vehicles are left entirely at the owners risk, however we do have a CCTV system.

  22. Limitation of liabilities

  • Braes Motorhome hire we accept no responsibility for replacement vehicle costs, travel or accommodation costs or any other loss claims arising from a motorhome breakdown or any accident or other such related causes.

  • The hirer is solely responsible for the costs of repair and or replacement as necessary in relation to damage to windows, windscreen, tyres and punctures.

  • The hirer is liable for all overhead damage to the vehicle resulting from any accident. The maximum height of the vehicle is clearly stated, the same applies to width and length.

  • The hirer is liable for all loss or damage arising from theft while the ignition keys of the vehicle have been left in or on the vehicle.

  • The hirer is responsible for the cost to recover a vehicle which has become bogged.

  • The hirer is responsible for all equipment breakages, or damage caused by the hirers negligence and must be repaired/made good at the hirers own expense within the living area.

  • The hirer will release Braes Motorhome Hire and any employees from any liability (regardless of who is at fault) for any loss or damage to any property left in or on the vehicle, in any service vehicle or on Braes Motorhome Hire premises. For any loss or damage caused by breakdown, mechanical defect, accident or the vehicle being unsuitable for the hirer’s purpose.

 

  23.  Rental and other charges  I will pay Braes Motorhome Hire

  • All rental charges.

  • The security deposit.

  • The cancellation fee.

  • The cost of any damage to the vehicle or the property of any third party, subject to the insurance.

  • All government fees and duties etc.

  • All fines, penalties and accidents including third party property damage that was not reported on return of the vehicle; and any related administration costs sustained in relation to the vehicle during the rental period.

  • The daily rental rate for the period the vehicle is off fleet for accident repairs (demurrage).

  24. Terminating the agreement

Braes Motorhome Hire will terminate this agreement immediately and repossess the vehicle, and will charge all repossession costs including towing charges.

  • If the vehicle was acquired through fraud or misrepresentation.

  • The vehicle appears to be abandoned.

  • If you are in breach with any of the conditions of this agreement.

  • The vehicle is not returned on the return date and Braes Motorhome Hire believes that it will not be returned on date.

There will be no refund of any part in the event of such termination or repossession

   25. Terminating the agreement I will return the vehicle back to Braes Motorhome Hire

·         If any damage has occurred due to negligence from the hirer or any accidental damage.

·         You have to inform us immediately of any damages inside or outside of the vehicle.

·         If the vehicle is due to go out on hire to another customer, you must return it to Braes Motorhome Hire if asked to do so for repairs to be carried out.

·         There will be no refund given if your hire has to be returned early for repairs to be carried out before the next hire commences.

·         The daily rental rate charged for the period the vehicle is off hire for damages and accident repairs (demurrage)

  26. Change in terms & conditions

Braes Motorhome Hire reserves the right to amend any changes to this agreement and alter the rates at any time without notice. We reserve the right to cancel or decline hire to any person without notification or justification.

  27.  My warranties

I warrant that all the information provided by me to Braes Motorhome Hire with regards to this agreement is true.

  28. Entire agreement

The agreement of the terms and conditions constitutes the entire agreement between the parties, no other oral undertakings or agreements relating to the contents of this agreement. Braes Motorhome Hire reserves the right to update any hire charges without prior notice..

  29.  Proper law

This agreement shall be governed by the law of Scotland in which this agreement was signed. The parties agree to submit to the absolute jurisdiction of the Scottish courts.
